Once you have chosen your location (Phase 4) and secured your legal entity (Phase 2), you enter the most complex physical stage: Site & Facility Approvals. This is the process of getting the “Right to Operate” at a specific physical address. In India, this involves multiple departments, from the local municipality to the state pollution control board.

- Land & Zoning (The foundation).
- Factory & Building Approvals (For manufacturing).
- Environmental & Safety Compliance (The “Consent” layer).
- The “Shop & Establishment” License (For service/retail like a Chai Walla).
1. Land & Zoning: The Foundation
Before signing a lease or buying land, you must verify the Land Use / Zoning.
- Industrial Zone: The only place where heavy manufacturing is permitted.
- Commercial Zone: For offices, retail, and service businesses (like a premium tea outlet).
- Residential / Agricultural: Generally prohibited for business unless a “Change of Land Use” (CLU) is obtained, which is a lengthy and uncertain process.
Verification Checklist:
- Title Deed / Lease Agreement: Ensure the owner has the legal right to lease for business use.
- Conversion Certificate: Proof that the land is converted for non-agricultural use.

4. The “Shop & Establishment” License (Service/Retail)
If you are a Chai Walla or a small consultancy, you likely don’t need a Factory License or a CTE/CTO. You need the Shop & Establishment Registration from the local Labor Department.
