Phase 3: Product Category & Compliance
Introduction
In the “Build in India” framework, compliance is split into two layers: Entity Compliance (Phase 2) and Product Compliance (Phase 3). While Phase 2 is about the container, Phase 3 is about the content.
Before you start production or sourcing, you must understand the mandatory standards, safety certifications, and labeling rules that apply to your specific product category. Failure to do so can lead to custom seizures (for imports), product recalls, or legal penalties.
This section covers:
- Mandatory Certification Regimes (BIS, FSSAI, CDSCO, etc.).
- Category-Specific Playbooks (Electronics, Food, Textiles, etc.).
- Labeling & Packaging Compliance (The “Face” of your product).
- Testing & Validation Strategy.
1. Mandatory Certification Regimes: The “Big Three”
I. FSSAI (Food Safety and Standards Authority of India)
- Who it’s for: Anyone involved in manufacturing, processing, packaging, storage, or distribution of food products.
- Includes: Everything from a local Chai Walla to a large-scale packaged snack factory.
- Tiers:
- Basic Registration: For petty food businesses (Turnover < ₹12 Lakhs).
- State License: For mid-sized businesses (Turnover ₹12 Lakhs to ₹20 Crores).
- Central License: For large-scale manufacturers, importers, or businesses operating in multiple states.
- Key Requirement: Strict adherence to hygiene, infrastructure standards, and periodic lab testing of water/food.
II. BIS (Bureau of Indian Standards)
- Who it’s for: Manufacturers of electronics, electrical appliances, toys, chemicals, steel, and solar equipment.
- Key Schemes:
- ISI Mark: Mandatory for products like cement, electrical cables, and infant food. It signifies safety and quality.
- CRS (Compulsory Registration Scheme): Mandatory for IT and Electronics products (Mobile phones, laptops, power banks).
- Process: Requires sample testing in BIS-recognized labs and a factory audit (for ISI).
III. CDSCO (Central Drugs Standard Control Organization)
- Who it’s for: Pharmaceuticals, medical devices, and cosmetics.
- Key Focus: Safety, efficacy, and clinical validation.
- Cosmetic Registration: Even non-medical cosmetics (shampoos, creams) require registration to ensure they don’t contain banned chemicals.
2. Category-Specific Playbooks: Quick Reference
A. Electronics & Hardware
- Primary Compliance: BIS (CRS).
- Secondary: WPC (Wireless Planning & Coordination) if the product has Bluetooth/Wi-Fi.
- Sustainability: E-Waste Management Rules (EPR - Extended Producer Responsibility).
B. Textiles & Apparel
- Primary Compliance: Mandatory Fiber Labeling (Cotton vs. Polyester).
- Sustainability: Zero Liquid Discharge (ZLD) norms for dyeing units.
- Exports: Compliance with global standards like OEKO-TEX or GOTS (Organic).
C. Toys & Children’s Products
- Primary Compliance: Mandatory BIS certification (ISI Mark). No toy can be sold or imported in India without it.
- Safety: Testing for phthalates, heavy metals, and mechanical safety (sharp edges, small parts).
D. Chemicals & Hazardous Materials
- Primary Compliance: PESO (Petroleum and Explosives Safety Organization) for storage and transport.
- Environmental: Strict “Red Category” pollution control norms.
3. Labeling & Packaging Compliance: The Legal Metrology Act
The Legal Metrology (Packaged Commodities) Rules apply to almost all pre-packaged goods sold in India. Your packaging must display:
- Common name of the commodity.
- Net quantity (in standard units like kg, liters, units).
- MRP (Maximum Retail Price) inclusive of all taxes.
- Month and Year of manufacture/packaging.
- Expiry/Best Before Date (where applicable).
- Customer Care details (Name, Address, Email, Phone).
- Manufacturer/Importer Details (Full name and address).
4. Testing & Validation: Building Your “Quality File”
Before launch, you should build a “Quality File” for your product:
- Raw Material COAs: Certificates of Analysis from your suppliers.
- Third-Party Lab Reports: Testing your finished product for safety and performance in NABL-accredited labs.
- Prototype Validation: Ensuring the product meets the specifications defined in Phase 1.
Summary for AI Report Generation
The AI must identify the Product DNA and trigger the relevant compliance logic:
- Chai Walla: Trigger FSSAI Basic Registration + Legal Metrology (if selling packaged tea).
- Mobile Phone Brand: Trigger BIS CRS + WPC + EPR (E-waste).
- Soap Manufacturer: Trigger CDSCO Cosmetic Registration + Legal Metrology.
The AI should provide a “Compliance Roadmap” with estimated timelines and typical costs for each certification.
